Terms of Service

These Terms of Service ("Terms") are an agreement between you and FigRank ("FigRank", "we", "us"). They apply to the FigRank website and application (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.

1. What FigRank is

FigRank is a research tool for online sellers. It shows which listings and products appear to be selling faster than normal, lets you follow listings, shops and keywords, and helps you write your own listing text. FigRank is an independent service. It is not made, sponsored, approved or endorsed by Etsy, Inc. "Etsy" is a trademark of Etsy, Inc.

2. Early access

The Service is opening to a small group of sellers first. Access is by invitation and we may approve, decline, limit, suspend or end access to anyone at any time, for example to keep the Service fast and fair for everyone. Features, limits and the way the Service works can change while we are in early access.

3. Your account

• You must be at least 18 years old and able to enter a binding agreement.
• Give us a real email address and keep your sign-in details secret. You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
• One account is for one person. Do not share your login or sell access to it.
• You can turn on a 2-step code for extra protection and you can delete your account at any time from your account page.

4. Acceptable use

You agree not to:

• copy, scrape, resell, or republish the Service or its results in bulk, or build a competing product from them;
• try to get around limits, security, access controls or the daily allowance on your account;
• probe, attack, overload or interfere with the Service or other people's accounts;
• use the Service to break the law, to infringe other people's rights, or to break the rules of Etsy or any other marketplace you use;
• upload anything unlawful, or anything you do not have the right to use.

5. Connecting your shop

Some features need you to connect your own Etsy shop. You do this by signing in on Etsy's own page and approving the access you choose. We only use that access for the features you turn on, and we change your listings only after you press the button to do so and we keep the old text so you can undo it. You can end the connection at any time in FigRank and in your Etsy account settings. You must follow Etsy's terms for any shop you connect.

6. Numbers, estimates and your decisions

Results in FigRank are labelled as Measured, Estimated, Imported or Sample. Estimates, forecasts, scores and ideas are aids to your own judgement. They are not promises or guarantees of sales, rankings or income. You decide what to make, list and spend, and you are responsible for those decisions.

7. Text written for you

Where FigRank helps write titles, tags or descriptions, you are responsible for checking them before you publish. Make sure they are accurate, that you have the right to sell the product, and that they follow the rules of the marketplace where you list.

8. Third-party services

The Service uses data and services from third parties, including Etsy's official API, email delivery and text-writing providers. They can change or become unavailable, and we are not responsible for them. Your use of Etsy is covered by Etsy's own terms.

9. Our rights and your content

We own the Service, its design, software and the compiled results it shows. We give you a personal, non-exclusive, non-transferable right to use it for your own business while your account is active. Lists, notes and files you add stay yours. You give us permission to store and process them only to run the Service for you.

10. Availability and changes

We work to keep the Service available, but it is provided "as is" and "as available". It may be interrupted for maintenance, limits set by third parties, or events outside our control. We may change or remove features, and we will try to tell you about changes that matter.

11. Limit of liability

To the fullest extent allowed by law, we are not liable for lost profits, lost sales, lost data or indirect or consequential losses, and our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the three months before the claim (or, if the Service was free, to a small fixed amount of 100 US dollars). Nothing in these Terms limits liability that cannot be limited by law, and your legal rights as a consumer, where you have them, are not affected.

12. Ending your access

You may stop using the Service and delete your account at any time. We may suspend or close an account that breaks these Terms or puts the Service or other people at risk. Sections that by their nature should continue (such as 9, 11 and 14) continue after your access ends.

13. Changes to these Terms

We may update these Terms. When we make an important change we will tell you by email or in the Service. If you keep using the Service after a change takes effect, you accept the new Terms.

14. Governing law

These Terms are governed by the laws that apply where FigRank is established, and the courts there can decide disputes, unless the law of your country gives you the right to bring a claim where you live.
